ImageImageIt can be safely stated that Roman Catholic Bishop Carlos Duarte Costa former Diocesan Bishop of Botucatu & later Titular Bishop of Maura had never been excommunicated by Rome. His Eminence; Cardinal Leme da Silveira Cintra; Archbishop of Sao Sebastiao do Rio de Janeiro. Cardinal-Priest of Ss. Bonifacio ed Alessio gave Roman Catholic Bishop Carlos Duarte Costa former Diocesan Bishop of Botucatu & later Titular Bishop of Maura, Episcopal Protection and full authority with his sacraments from 1937 until his death in 1942. Such actions by His Eminence; Cardinal Leme da Silveira Cintra; Archbishop of Sao Sebastiao do Rio de Janerio. Cardinal-Priest of Ss. Bonifacio ed Alessio would have been a direct violation against Roman Catholic Canon Law and the Papacy if he had associated and or communicated with Bishop Carlos Duarte Costa former Diocesan Bishop of Botucatu, later Titular Bishop of Maura if he had been  Excommunicated or even Schismatic.

Therefore; it can be stated that His Eminence; Cardinal Leme da Silveira Cintra gave in writing his authority for then Titular Bishop Carlos Duarte Costa to consecrate bishops and use his authority for full sacramental privileges. As a Cardinal 'Priest' and resident ordinary of the Roman Catholic Church by the above actions it is to be seen also as affirmed both de jure and de facto .

Our Bishops outside of the Roman Catholic Church Vatican II are not only heralds, but custodians of the most ancient and a powerful continuous spiritual lineage that still exists in Apostolic Succession from Vatican I.

A titular is occasionally transfered from that of a diocesan bishop to a titular see, this has been used by the Roman Holy See to strip the diocesan of his responsibilities. A bishop whose behaviour was disapproved of. Assigning titular sees serves two purposes. Since part of being a bishop means being the head of a church, titular sees serve that purpose for bishops without a diocese. At the same time, the office of titular bishop memorializes ancient churches that fell into the hands of non-Christian conquerors, formerly in partibus infidelium, or that were absorbed into other dioceses. Prior to 1970, all titular bishops, with the exception of suburbicarian Cardinal Bishops, held a titular see.

Since 1970, there are two more exceptions. Retired diocesan bishops are no longer transferred to a titular see. Instead, they take the title Bishop Emeritus of the former see. Also, coadjutors are no longer named to titular sees, instead taking the title Coadjutor Bishop of the see they will inherit. Auxiliary bishops and all other titular bishops still take a titular see.

Never the less: they still have by right of consecration, a titular can validly, but not licitly, without permission of the residential 'In this case Cardinal Silveria leme de Cintra', perform all the functions annexed to the Episcopal order by Divine and ecclesiastical law. Hence the importance of the case of His Eminence Cardinal Leme da Cintra’s consent and that  Bishop Duarte Costa as a Titular Bishop of Maura living in Rio de Janerio after his resignation to the Roman Catholic Church did assist in consecrations as a principal co consecrator in the consecration of Bishop Eliseu Maria Coroli, B. † on 13.10. 1940 . Bishop Eliseu Coroli served on all 4 councils of  Vatican II.
